Welcome to the ICLEI \u2013 Local Governments for Sustainability \u2013 South America website!<\/p>\n

ICLEI is an international non-governmental organisation that values the privacy and protection of personal data of all individuals with whom it relates, directly or indirectly.<\/p>\n

This Privacy Notice aims to clearly and transparently explain how we collect, use, store, share and protect your personal data when you access and use our website.<\/p>\n

We only collect the data strictly necessary to fulfil the purposes described herein, always in compliance with the General Law for the Protection of Personal Data \u2013 LGPD (Law No. 13.709\/2018) and other applicable regulations.<\/p>\n

\nII. Sensitive Personal Data: data concerning racial or ethnic origin, religious beliefs, political opinions, trade union membership, data concerning health, sexual life, genetic or biometric data.

\nIV. Processing: any operation carried out on personal data, such as collection, use, storage, sharing and erasure.
\nV. Controller: the person or organisation that determines the processing of personal data.
\nVI. Controller: the party that carries out the processing on behalf of the controller.
\nVII. Data Protection Officer (DPO): a person appointed to act as a point of contact between the data controller, data subjects and the ANPD.
\nVIII. International Transfer: the transfer of personal data to another country or international body.<\/p>\n

5. WHY DO WE PROCESS YOUR PERSONAL DATA?<\/strong><\/span><\/p>\n

\nVI. Ensuring system security and fraud prevention;

In order for us to provide our services, carry out our institutional activities, respond to requests and provide information, ICLEI processes personal data in an appropriate, relevant and limited manner for the stated purposes, in compliance with the principles set out in the applicable legislation.<\/p>\n

7.1. Personal data provided directly by you<\/u><\/p>\n

During your relationship with us, you may provide personal data by completing the forms available on our website.<\/p>\n\n\n\n\n\n\n\n\n

The personal data submitted by you to the contact email provided on the website (juridico@iclei.org<\/a>shall be used exclusively for:<\/p>\n

I. Applicant identification; and
\nII. Handling, response, or referral of the request made.<\/p>\n

Communications are treated with confidentiality and used only for the purposes described above.<\/p>\n

7.3. General processing purposes<\/u><\/p>\n

In addition to the specific purposes indicated above, personal data collected via the website may be processed for:<\/p>\n

I. To permit the proper access and use of the website;
\nII. Respond to queries, requests and demands from users;
\nIII. Provide technical and administrative support;
\nIV. To guarantee the operation, stability and security of the website and its systems;

7.5. Curricula and recruitment processes<\/u><\/p>\n

Any CVs submitted for participation in selection processes will be handled in accordance with the applicable Internal Privacy Policy for recruitment and selection processes.<\/p>\n

7.6. Voluntary nature of data provision<\/u><\/p>\n

The provision of personal data is, as a general rule, voluntary. However, refusal to provide certain information may limit or prevent the fulfilment of specific requests or the provision of certain services, in which case you will be informed, whenever possible.<\/p>\n

8. HOW LONG IS THE DATA STORED?<\/strong><\/span><\/p>\n

Personal data will only be stored for as long as necessary to fulfil the purposes for which it was collected or as required by law.<\/p>\n

After this period, the data will be deleted or anonymised, unless retention is necessary for:<\/p>\n

I. Compliance with a legal or regulatory obligation;
\nII. Regular exercise of rights;
\nIII. Preservation of legitimate interests, within the limits of the law.<\/p>\n

9. THIS IS JUST A DATA SHARE<\/strong><\/span><\/p>\n

In the development of its institutional activities, ICLEI may share personal data, always to the minimum extent necessary, with entities that assist in the execution of its activities or when there is a legal basis for doing so.<\/p>\n

Personal data sharing occurs exclusively when necessary for the fulfilment of the purposes stated in this Privacy Notice and upon the adoption of appropriate technical and organisational measures for the protection of personal data.<\/p>\n

9.1. With whom your data may be shared<\/u><\/p>\n

Your personal data may be shared, but not exhaustively, with:<\/p>\n

I. Entities that are part of ICLEI, in Brazil or abroad, when necessary for the execution of institutional activities;
\nII. Partners, service providers and suppliers, acting as independent operators or controllers, exclusively to enable the execution of ICLEI services, projects or activities;
\nIII. Public entities, administrative or judicial authorities, when sharing is required by law, regulation or court order, or is necessary for the regular exercise of ICLEI's rights in administrative, arbitration or judicial proceedings.<\/p>\n

9.2. Safeguards adopted<\/u><\/p>\n

Whenever there is sharing, ICLEI:<\/p>\n

I. Assess the need for and appropriateness of sharing;
\nII. Where applicable, require contractual commitments for confidentiality and data protection;
\nIII. Ensure that third parties adopt security and privacy standards compatible with the LGPD and this Privacy Notice.<\/p>\n

10. INTERNATIONAL TRANSFERS OF PERSONAL DATA<\/strong><\/span><\/p>\n

Considering ICLEI's international operations, there may be international transfers of personal data to other countries or international organisations, where necessary for the execution of institutional activities, the provision of services, cooperation between ICLEI entities, or the enhancement of the security and quality of our services.<\/p>\n

International transfers of personal data are carried out in compliance with the LGPD, through the adoption of adequate safeguards, such as:<\/p>\n

I. contractual clauses that ensure a level of data protection compatible with the LGPD;
\nII. Confidentiality and information security commitments;
\nIII. Other legally admissible mechanisms for the international transfer of data.<\/p>\n

ICLEI undertakes to ensure that personal data transferred is processed in accordance with the data protection principles set out in Brazilian legislation, regardless of the country of destination.<\/p>\n

11. HOW WE PROTECT YOUR PERSONAL DATA<\/strong><\/span><\/p>\n

ICLEI adopts appropriate technical and administrative measures to protect personal data against unauthorised access, destruction, loss, alteration, disclosure, or any other form of improper or unlawful processing.<\/p>\n

Among the measures adopted, the following stand out: music<\/p>\n

I. Use of secure connection (HTTPS) and security certificates (SSL);
\nII. Access controls for systems and information;
\nIII. Internal privacy and information security policies and procedures;
\nIV. Periodic monitoring of digital systems and environments;
\nV. Use of protective mechanisms, such as encryption and firewalls, where applicable.<\/p>\n

Despite the adoption of good practices and high security standards, it is important to note that no data transmission or storage is completely risk-free.<\/p>\n

In the event of security incidents that may lead to significant risk or harm to data subjects, ICLEI will promptly adopt the necessary measures to mitigate their effects and, when required by law, will communicate them to the data subjects and the competent authority, ensuring due transparency.<\/p>\n

12. WHAT ARE YOUR RIGHTS AS A DATA SUBJECT<\/strong><\/span><\/p>\n

ICLEI is committed to respecting the confidentiality of your personal data and ensuring the exercise of all rights provided for by applicable legislation, in a free, facilitated, and transparent manner.<\/p>\n

12.1. Rights assured to the holder<\/u><\/p>\n

Under the terms of Article 18 of the LGPD, you have, among others, the following rights:<\/p>\n

I. Confirmation of the existence of processing of your personal data;
\nII. Access to personal data processed;
\nIII. Correction of incomplete, inaccurate or outdated data;
\nIV. Anonymisation, blocking or deletion of unnecessary, excessive or unlawfully processed personal data;
\nV. Information about the purposes and manner of processing your personal data;
\nVI. Deletion of personal data processed with consent, where applicable;
\nVII. Information about public and private entities with whom personal data has been shared;
\nVIII. The possibility of not giving consent and of being informed of the consequences of such refusal, where consent is required;
\nIX. Withdrawal of consent at any time, where this is the applicable legal basis;
\nX. Request for data portability, in accordance with the rules of the National Data Protection Authority.<\/p>\n

12.2. Limitations on the exercise of rights<\/u><\/p>\n

In certain situations, the data subject's request may not be fully complied with, within the limits permitted by law, such as in cases of:<\/p>\n

I. Compliance with a legal or regulatory obligation by the controller;
\nII. Existence of a valid and effective contract;
\nIII. Necessity of retaining data for minimum periods stipulated by law;
\nIV. Regular exercise of rights in judicial, administrative or arbitration proceedings.<\/p>\n

In these circumstances, the holder will be duly informed, in a clear and reasoned manner.<\/p>\n

12.3. Consent<\/u><\/p>\n

When the processing of personal data is based on consent, it shall be requested in a freely given, specific, informed and unambiguous manner, for specified purposes.<\/p>\n

The data subject may revoke their consent at any time, by requesting it from the Data Protection Officer, without prejudice to the lawfulness of the processing carried out previously based on valid consent.<\/p>\n

12.4. Confirmation of identity<\/u><\/p>\n

For security and fraud prevention purposes, it may be necessary to request additional information or documents to confirm the identity of the data subject exercising their rights. In this event, the data subject will be informed in advance of the necessity and reason for the request.<\/p>\n
